Terms of Service

Welcome to Daily Rundown. These Terms of Service ("Terms") govern your access to and use of the Daily Rundown mobile application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading, or using Daily Rundown, you confirm that you:

• Are at least 18 years old or have parental/guardian consent
• Have the legal capacity to enter into these Terms
• Will comply with all applicable laws and regulations
• Agree to our Privacy Policy

2. Description of Service

Daily Rundown is an AI-powered mobile application that provides personalized audio briefings by aggregating and summarizing information from:

• Your connected calendar accounts (Google Calendar, Apple Calendar)
• Weather data based on your location
• Curated news sources (Daily Rundown News)
• Custom RSS feeds (Premium tier only)
• Personal memory dashboard entries (Premium tier only)

The Service uses artificial intelligence (Google Gemini) to generate briefing scripts and text-to-speech technology (Google Cloud TTS) to create audio content.

3. Account Registration and Security

3.1 Account Creation

You may create an account using:

• Google OAuth authentication
• Apple Sign-In

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Requirements

You agree to:

• Provide accurate and complete information during registration
• Update your information to keep it current
• Not share your account with others
• Notify us immediately of any unauthorized access
• Not create multiple accounts to circumvent service limitations

4. Subscription and Payment

4.1 Service Tiers

FREE Tier: Includes up to 2 briefings per day, Google & Apple Calendar integration, weather, and Daily Rundown News.

PREMIUM Tier ($4.99/month): Includes up to 10 briefings per day, custom RSS feeds, Memory Dashboard, voice input, personalized news research, and Life Coach mode.

4.2 Billing and Subscriptions

Premium subscriptions are processed through:

• Apple App Store (for iOS users)
• Google Play Store (for Android users)

By subscribing, you agree to:

• Automatic recurring monthly billing
• The pricing displayed at the time of purchase
• Charges to your Apple ID or Google Play account

4.3 Free Trial

Premium subscriptions may include a 7-day free trial. You will be charged at the end of the trial period unless you cancel before then. To avoid charges, you must cancel at least 24 hours before the trial ends.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. Refunds are subject to the policies of Apple or Google, not Daily Rundown.

4.5 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.

5. Third-Party Integrations

5.1 Calendar Access

By connecting your Google or Apple Calendar, you grant us read-only access to your calendar events and tasks. We fetch events on-demand and do not store calendar data permanently on our servers.

5.2 OAuth Permissions

You can revoke calendar access at any time through:

• Google Account settings (myaccount.google.com)
• Apple ID settings (appleid.apple.com)
• Daily Rundown app settings

5.3 Weather Data

Weather information is provided by OpenWeatherMap and is for informational purposes only. We are not responsible for the accuracy of weather forecasts.

5.4 News Sources

Daily Rundown News aggregates content from third-party news sources (BBC, NPR, Reuters, etc.). We do not control or endorse the content of external news sources. All content remains the property of the original publishers.

6. User Content and Data

6.1 Memory Dashboard (Premium)

The Memory Dashboard allows you to store personal information (family details, routines, health information, interests). This data is:

• Encrypted at rest using industry-standard encryption
• Used solely to personalize your briefings
• Never shared with third parties without your consent
• Accessible only to you

6.2 Voice Input (Premium)

When you use voice input, audio recordings are:

• Transcribed using Google Cloud Speech-to-Text
• Deleted immediately after transcription (never stored)
• Processed to extract facts for your Memory Dashboard

6.3 Data Retention

• Briefings: Automatically deleted after 48 hours (FREE) or 7 days (PREMIUM)
• Memory Dashboard: Retained until you delete it or close your account
• Audit Trail: Dossier change history retained for 30 days
• Pending Updates: Expire after 24 hours

7. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose
• Reverse engineer, decompile, or disassemble the app
• Attempt to gain unauthorized access to our systems
• Use automated tools to scrape or collect data from the Service
• Abuse or exploit bugs for personal gain
• Harass, impersonate, or harm other users
• Upload malicious code or viruses
• Violate any applicable laws or regulations

8. Intellectual Property

8.1 Our Rights

All intellectual property rights in the Service, including the app, website, logos, branding, and AI-generated content, are owned by Daily Rundown or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

8.2 Your Rights

You retain ownership of any content you create or upload (e.g., Memory Dashboard entries, voice recordings before transcription). By using the Service, you grant us a license to process this content solely to provide the Service.

8.3 Third-Party Content

News articles, RSS feed content, and weather data remain the property of their respective publishers and providers.

9. AI-Generated Content

Daily Rundown uses artificial intelligence (Google Gemini 2.5 Flash) to generate briefing scripts. While we strive for accuracy, AI-generated content:

• May contain errors, inaccuracies, or outdated information
• Should not be relied upon for critical decisions
• Is provided "as-is" for informational purposes only
• Does not constitute professional advice (legal, medical, financial, etc.)

You acknowledge that AI models can make mistakes and agree to verify important information independently.

10. Disclaimers and Limitations of Liability

10.1 Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted or error-free operation
• That defects will be corrected
• That the Service is free from viruses or harmful components

10.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILY RUNDOWN SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from your use or inability to use the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Daily Rundown, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the Service
• Your violation of any third-party rights

12. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

12.1 GDPR Compliance

For users in the European Economic Area (EEA), we comply with the General Data Protection Regulation (GDPR). You have the right to:

• Access your personal data
• Correct inaccurate data
• Delete your data (right to be forgotten)
• Export your data (data portability)
• Object to data processing

13. Account Termination

13.1 Your Right to Terminate

You may delete your account at any time through the app settings. Upon deletion:

• Your account and associated data will be permanently deleted within 30 days
• Active subscriptions will be canceled (no prorated refunds)
• You will lose access to Premium features immediately

13.2 Our Right to Terminate

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or other users
• Fail to pay subscription fees

We will provide notice when reasonably possible, except in cases of legal requirements or severe violations.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Notify you via email or in-app notification
• Update the "Last Updated" date at the top of this page
• Provide at least 30 days' notice for material changes

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

15.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis, and you waive the right to participate in class actions or class-wide arbitration.

16. General Provisions

16.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Daily Rundown.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms to any successor or affiliate.

16.5 Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, government actions, internet outages).
